As a senior staff attorney your responsibilities will include:

  • Researching and providing legal advice regarding Medicaid's dealings with managed care entities
  • Reviewing and providing legal advice related to contract compliance and oversight
  • Assisting with activities related to public records requests
  • Researching and drafting legal opinions, memoranda, and other legal documents regarding Medicaid issues The preferred candidate will possess strong legal analysis skills, be detail oriented, and be able to work collaboratively and independently. Job Description: Under administrative direction, provides legal advice and counsel to the Ohio Department of Medicaid (ODM) Director, Deputy Directors, and appropriate staff regarding matters of state agency administration & federal/state compliance with Ohio's Medicaid program; provides legal advice & counsel to Director, Deputy Directors & appropriate staff on legal matters affecting offices/bureaus within ODM (e.g., Chief of Staff, Operations, Policy, Health Innovation and Quality) & other offices related to administration of medical programs; acts as a liaison between ODM staff and the Office of the Attorney General, other State agencies, county agencies/boards, managed care plans, the Single Pharmacy Benefit Manager, and other private or public entities in reference to legal issues; represents agency in legal matters; assists in preparing cases and evidence for trials, hearings & appeals; provides legal advice to ODM on Medicaid, disability, contract, procurement, state budget, COVID-19, & other administrative law matters related to health care; participates in the Medicaid audit resolution process; reviews and assesses court cases for potential settlement &/or placement in appropriate review process (i.e., Chapter 119, reconsideration) if not resolved; reviews settlement proposals & makes recommendations to senior staff. Drafts and/or reviews documents related to ODM procurement and vendor onboarding and oversight projects as well as ongoing contract compliance (e.g., letters, memoranda, contracts, grant agreements, inter-agency agreements, data sharing agreements, & memoranda of understanding); works with program area staff to obtain a complete understanding of the services &/or goods to be purchased & the compensation structure; makes corrections to documents based on reviews by program area staff, vendors & Bureau Chief (or other senior reviewer); researches applicable legal authority for procurement projects and implementation and prepares and communicates advice and guidance to Director and senior leadership to ensure compliance; reviews and responds to complex public records requests related to procurement projects; attends meetings related to procurement and implementation; assists agency staff with inquiries and identifies issues related to vendor compliance; provides legal assistance with respect to administrative appeal processes related to implementation of Ohio Medicaid Enterprise Systems (OMES) modules. Researches & drafts legal opinions, orders, memoranda & other legal documents related to Medicaid, contract and procurement processes, state medical programs, state budget, COVID-19, & other administrative law; provides legal services to Director, Deputy Directors & departmental staff related to program administration & operations; provides training to ODM staff on substantive legal issues; represents agency at administrative hearings; researches law, develops & enforces procedures & prepares advice, guidance, memoranda and other legal documents for Director and senior leadership; conducts negotiations on behalf of department in matters related to administration of Medicaid programs. Analyzes, reviews, and interprets legislation; drafts legislation and Ohio Administrative Code rules; reviews proposed rules and rule comments and other related materials; researches and responds to inquiries from the Common Sense Initiative Office (CSIO); responds to inquiries from public and government officials; reviews and drafts State Plan Amendments (SPAs) and other related communications between ODM and the Centers for Medicare and Medicaid (CMS); reviews and responds to public records requests; operates personal computer and applicable software applications (e.g., Word, Excel, Access, Outlook, TEAMS) to create, store, retrieve and produce correspondence, briefs, position papers and reports. Performs other duties as assigned (e.g. attends and participates in staff meetings and training sessions); attends meetings; travels to meeting sites and hearings; maintains necessary records, logs and files. Qualifications Admission to Ohio Bar pursuant to Section 4705.01 of Revised Code; 12 mos. exp. as licensed attorney; 6 mos. exp. in employee training & development. Knowledge of law (i.e., procedural & substantive); legal research methods; legal writing; interviewing; laws, rules & procedures applicable to operations of employing agency; supervisory principles/techniques*; employee training & development. Ability to deal with large number of variables & determine specific course of action; organize & interpret extensive variety of legal material in books, journals or legal documents; communicate verbally regarding legal issues; handle sensitive contacts with government officials, adverse parties &/or general public.

    Completion of 24 credit hours of continuing legal education from accredited programs for applicable two-year reporting period pursuant to Rule X of Rules of Government of Bar of Ohio. Current certificate of registration pursuant to Rule VII of Rules of Government of Bar of Ohio. This position is overtime exempt. This position is unclassified per 124.11 (A) (9), Ohio Revised Code. Travel required, as needed. Must provide own transportation. Or, in order to operate a state vehicle, you must have a valid driver's license from state of residence.
